Bank Secrecy

The new legislation governing banking institutions came into force in 1992. Section 14 includes a legal definition of banking secrecy, to which not only banking institutions but also finance companies are subject. Banking secrecy is, in its formal expression comparable to that practised in Switzerland or Luxembourg, but can be categorised as more stringent. It takes the form of professional secrecy and the duty to keep secrecy can only be set aside in cases under the criminal law.

The legislation governing banking institutions and finance companies however provides no protection for assets generated by criminal acts.
